General Terms and Conditions (GTC) – “Sensuri Homes” SWITZERLAND (CH)
For sales and deliveries exclusively within Switzerland.

1. Scope of Application and Seller
1.1. These General Terms and Conditions (GTC) govern the contractual relationship between Sensuri de Catarina Alexandra da Silva Piteira (hereinafter “Seller”), with its registered office in Broc, Fribourg, Switzerland (CHE-390.785.492), and its customers with a delivery address in Switzerland (hereinafter “Customer”), for the sale of furniture (“Sensuri Homes”).
2. Manual Ordering Process and Conclusion of Contract
2.1. Ordering Process (Switzerland): Orders for delivery in Switzerland are processed manually via customer service (e.g., by email to info@sensuri.ch).
2.2. Acceptance of GTC: By submitting an order request to the Seller, the Customer unequivocally confirms that they have read, understood, and fully accepted these GTC, which are publicly available on the Seller’s website.
2.3. The contract is concluded only when the Seller sends a written order confirmation (email), which will include the invoice and payment details.
3. Prices and Taxes (All-Inclusive – DDP)
3.1. Prices are communicated to the Customer by the Seller (e.g., in Swiss Francs, CHF) and are final prices.
3.2. “All-Inclusive” (Delivered Duty Paid): The final price includes all costs: the Swiss Value Added Tax (VAT/TVA), as well as all customs duties and import fees. The Seller is responsible for the entire import process.
3.3. The Customer will not receive any additional charges from the courier or customs upon delivery.
4. Payment
4.1. The accepted payment method is exclusively bank transfer (advance payment). The bank details (IBAN) will be provided to the Customer with the order confirmation and invoice.
4.2. Order processing and dispatch will only begin after receipt and confirmation of the full payment in the Seller’s account.
4.3. Retention of Title: The products remain the property of the Seller until full payment has been received.
5. Logistics and Delivery
5.1. Logistics: The Seller imports the goods (sourced from partners in the EU) into Switzerland in bulk. The final delivery to the Customer is organized by the Seller and carried out from Switzerland (Broc) by a local transport partner.
5.2. Furniture Delivery: Delivery of bulky items is made to the Customer’s residence door (e.g., apartment door). a) This delivery assumes that the final delivery location is accessible by normal means (e.g., elevator or stairwells with sufficient space for the packaged products). b) The Customer is solely responsible for verifying in advance that the ordered products (in their packaging) can be transported to the final delivery location. c) Additional costs resulting from difficult access (e.g., need for an external lift, manual transport to upper floors without an elevator, or if access is deemed unsafe by the carrier) will be charged separately to the Customer.
5.3. The risk of loss or damage is transferred to the Customer upon delivery.
6. Return Policy (Furniture)
6.1. The Seller offers a voluntary right of return of 5 (five) days from receipt of the products.
6.2. Products must be returned in their original packaging, unused, and complete.
6.3. All shipping costs for the return are borne entirely by the Customer.
6.4. For furniture returned for convenience (i.e., not defective), a restocking fee of 15% (fifteen percent) of the product’s sales value will be applied.
6.5. The Customer must contact info@sensuri.ch to obtain return authorization.
7. Warranty (Defects)
7.1. The Seller adheres to the Swiss legal warranty (Art. 197 et seq. of the Swiss Code of Obligations – CO). The warranty period for defects is two (2) years from the date of delivery.
7.2. The Customer must inspect the products immediately upon receipt and notify the Seller in writing (with photos) of any apparent (visible) defects within 5 (five) working days.
8. Data Protection
8.1. Data processing is governed by the Swiss Federal Act on Data Protection (FADP/nFADP).
9. Final Provisions
9.1. Applicable Law: This contract is governed exclusively by Swiss Law.
9.2. Place of Jurisdiction: The exclusive place of jurisdiction is the Seller’s registered office in Broc, Canton of Fribourg. The mandatory place of jurisdiction provided by law for consumers (usually the consumer’s domicile) is reserved.

1. Scope of Application and Seller
1.1. These General Terms and Conditions (GTC) govern the contractual relationship between Sensuri Homes Unipessoal Lda. (hereinafter “Seller”), with its registered office at Rua Cidade de Lagos 12, 2725 Mem Martins, Portugal, VAT ID PT 519009231, and its customers residing in the European Union (hereinafter “Customer”).
1.2. These GTC are based on Portuguese legislation (Decree-Law No. 24/2014) and the EU Consumer Rights Directive (2011/83/EU).
2. Conclusion of the Contract
2.1. The presentation of products in the online shop is an invitation to treat.
2.2. By clicking the “Complete Purchase” button, the Customer makes a binding offer. The contract is concluded when the Seller sends an order confirmation via email.
3. Prices, Taxes (VAT), and Shipping (Dropshipping from Poland)
3.1. Prices are indicated in Euros (EUR).
3.2. Intra-Community Dispatch (No Import Fees): a) All products are shipped directly to the Customer from a partner logistics center located in Poland (European Union). b) As this is an intra-Community (EU-to-EU) dispatch, there are NO import duties or customs fees for the Customer.
3.3. VAT (Value Added Tax): The prices displayed include the legally applicable VAT, in accordance with the EU’s OSS scheme.
4. Payment
4.1. Accepted payment methods are: Credit Card (via Stripe), Google Pay, and MB Way (available only for customers in Portugal).
5. Delivery
5.1. The Seller delivers to the European Union countries listed during the checkout process. 5.2. The risk of loss or damage is transferred to the Customer upon delivery.
6. Right of Withdrawal (14 Days)
6.1. The Customer (consumer) has the right to withdraw from this contract within 14 (fourteen) days without giving any reason.
6.2. The withdrawal period will expire 14 days from the day on which the Customer acquires physical possession of the goods.
6.3. To exercise the right of withdrawal, the Customer must inform the Seller (info@sensurihomes.pt) of their decision by an unequivocal statement.
6.4. Effects of Withdrawal: a) The Seller will reimburse all payments received from the Customer. b) Reimbursement will be made within 14 days after the Seller receives the returned goods at the designated address (in Poland). c) The Customer shall bear the direct costs of returning the goods. Given that the products are furniture, these transport costs (return to Poland) can be significant. d) The Customer is only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.
7. Legal Guarantee of Conformity
7.1. The Seller is liable for any lack of conformity which exists at the time the goods were delivered.
7.2. Under Portuguese law (Decree-Law No. 84/2021), the warranty period for new movable goods is three (3) years from the date of delivery.
8. Data Protection (GDPR)
8.1. The processing of personal data complies with the EU General Data Protection Regulation (GDPR).
9. Online Dispute Resolution (ODR)
9.1. The European Commission provides a platform for Online Dispute Resolution (ODR), accessible here: http://ec.europa.eu/odr. 9.2. In the event of a dispute, the consumer may also refer to an Alternative Dispute Resolution (ADR) entity.
10. Applicable Law and Jurisdiction
10.1. This contract is governed by Portuguese Law.
10.2. However, the Customer (consumer) benefits from the protection afforded by the mandatory provisions of the law of their country of habitual residence within the EU (as per the Rome I Regulation).
10.3. The Customer may bring an action either in the courts of Portugal (the Seller’s headquarters) or in the courts of the place where the Customer is domiciled in the EU.
